Don't really understand the definition of hijacking please explain if the person has to be in the car or near for the suspect to be charged with hijacking?
If there's a website that explains definitions of crimes please mention... because I'd also like to understand the crime of theft by receiving and the yrs it carries if found guilty.

generally, hijacking is when you take the car from someone. so, yes, they have to be in the car and forced out by the hijacker. If they are not in the car, it's considered grand theft auto.

They don't have to be in the car. But they have to be with the car and be forced to give the car up. If they are not there, it is grand theft. Hijacking is worse but also involves grand theft.
